Privacy Policy

Our privacy policy and how we use your data

This Privacy Policy explains how encoderio (“we”, “us”) collects, uses, shares, and protects personal information when you use our website and services (the “Services”). Because we help form US companies, we necessarily handle identity and ownership information; we take its protection seriously.

1. Information we collect

  • Account information: name, email address, password, and language preference.
  • Company and filing information: proposed company names, formation state, business purpose, NAICS code, and principal address.
  • Identity and KYC information: full legal name, date of birth, nationality, residential address, passport or national ID details, and ownership percentage of the responsible party / owner.
  • Documents you upload: passports, proof of address, and similar files, stored in a private, access‑controlled bucket.
  • Payment information: processed by Stripe. We do not store your full card number; we receive limited billing metadata and subscription status.
  • Usage and device data: log data, IP address, and basic analytics needed to operate and secure the Services.

2. How we use information

  • To provide the Services: form your LLC, obtain an EIN/ITIN, facilitate banking, prepare documents, and file with government agencies.
  • To communicate with you about your account, orders, and case progress.
  • To process payments and manage subscriptions.
  • To comply with legal obligations, including anti‑money‑laundering, know‑your‑customer, and beneficial‑ownership requirements.
  • To protect the Services and prevent fraud or abuse.

3. Legal bases (EEA/UK users)

Where the GDPR or UK GDPR applies, we process personal data on the bases of performance of a contract (to deliver the Services you request), compliance with a legal obligation, our legitimate interests (to secure and improve the Services), and your consent where required (e.g., certain cookies).

4. How we share information

We share information only as needed to deliver the Services:

  • Government agencies (e.g., Secretaries of State, the IRS, FinCEN) to make the filings you request.
  • Registered agents, partner banks, and acceptance agents involved in your specific services.
  • Service providers that operate our platform, including Supabase (database, authentication, and file storage) and Stripe (payments).
  • Professional advisers and authorities where required by law, or to establish, exercise, or defend legal claims.

We do not sell your personal information.

5. International data transfers

The Services are operated using infrastructure located in the United States. If you access the Services from outside the US, your information will be transferred to and processed in the US and other countries that may have different data‑protection laws than your own.

6. Data retention

We retain personal information for as long as your account is active and as needed to provide the Services, and thereafter as required to comply with legal, tax, and recordkeeping obligations (which, for company‑formation and financial records, can be several years).

7. Security

We use technical and organizational measures to protect your data, including encryption in transit, access‑controlled storage, and row‑level security so that customers can only access their own records. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Your rights

Depending on your location, you may have the right to access, correct, delete, or port your personal data, to object to or restrict certain processing, and to withdraw consent. California residents have rights under the CCPA/CPRA, including the right to know and delete and the right not to be discriminated against for exercising those rights. To exercise any right, contact us at privacy@encoderio.com. You may delete your account at any time from your account settings.

9. Cookies

We use cookies and similar technologies as described in our Cookie Policy.

10. Children

The Services are not directed to children under 18, and we do not knowingly collect their personal information.

11. Changes to this policy

We may update this Privacy Policy from time to time. We will update the “Last updated” date and, where appropriate, notify you of material changes.
